This is a
contract between Blue Marble Beat, here after known as the party of the
first part, and the party of the second part (as identified above), to provide
band performance according to the above listed parameters.
The fee, less deposit is to be paid in full by the party of the second part
no later than the end time stated above. A deposit of 50% of the contracted
total fee above must be returned with a signed copy of this contract, in
the form of a check or money order, unless waived by the party of the first
part in advance, and acknowledged on this form.
By signing this contract the party of the second part will be held liable
for any damage to the equipment, gear or personnel of the party of the first
part, not caused by the party of the first part. The party of the
second part recognizes this document as a legal and binding contract in
the State of North Carolina. The party of the first part is not liable
for any accidents or injury caused by the music, lighting, sound equipment
or it’s personnel.
NOTE: Blue
Marble Beat may use strobe lights, fog machines, lasers, and other special
effects lighting. These lights may have adverse effects on people
with epilepsy.
The party of the second part must provide a clean, dry, flat, stable and
unobstructed performance area with at least two 15 amp A.C. circuts within
ten feet of the performance area. Due to the caliber of the professional
equipment used by Blue Marble Beat, we must have at least two full hours
prior to the start time to set up and test equipment. We also require
at least one full hour for tear down and load out.
Blue Marble Beat reserves the right to hang a banner up within 20 feet of
our performance area.
Playing To The Walls: Blue Marble Beat reserves the right to end the contracted playing time early in the event of ‘Playing To The Walls’. 'Playing To The Walls' may result if number of people in attendance falls to less than 10 people, for a period no less than 30 minutes. The first hour of any event is exempt from this rule.
Double booking: Double booking occurs when the party of the second part employs another entertainer to perform at the same time and place as Blue Marble Beat. The party of the second part agrees not to double book this show without the written permission of Blue Marble Beat. In the event of such a double booking, the party of the second part agrees to pay Blue Marble Beat the balance of the agreed fee and to release Blue Marble Beat from all contractual agreements.
This contract may be deemed void only by an act of God, the terms and conditions of said contract or at the mutual agreement of both parties.
NOTE: PLEASE MAKE ALL CHECKS PAYABLE TO BLUE MARBLE BEAT. SEND A SIGNED COPY OF CONTRACT, DEPOSIT, AND ANY ATTACHED FORMS BACK TO BLUE MARBLE BEAT AT THE ADDRESS ABOVE.
CONTRACT MUST BE RETURNED WITHIN 10 DAYS OF DATE ON CONTRACT OR IT MAY BE DEEMED VOID BY BLUE MARBLE BEAT.
